Terms of Service

1. Acceptance of these terms

By accessing or using SousDey (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, please do not use the Platform. These Terms apply to all visitors, travelers, and local guides who use SousDey to discover, book, or offer local experiences.

2. What SousDey is

SousDey is an online marketplace that connects travelers ("Travelers") with local people ("Locals" or "Guides") who offer personalized experiences in their city. SousDey provides the tools to find, book, communicate about, and pay for these experiences. SousDey is not a party to the agreement between a Traveler and a Local, and does not directly provide the tour or experience itself.

3. Your account

To use certain features, you must register and keep your account information accurate and complete. You are responsible for safeguarding your password and for all activity under your account. You must be at least 18 years old to create an account and book or offer experiences. You agree to notify us immediately of any unauthorized use of your account.

4. Travelers

As a Traveler, you agree to:

• Provide accurate booking details, including your name, contact information, and the dates you request.
• Treat your Local with respect and follow any reasonable safety or cultural guidance they offer.
• Pay the agreed amount for the experience through the Platform.
• Arrive on time; repeated no-shows may result in restrictions on your account.
• Not request or offer to pay a Local outside the Platform, as this removes protections for both of you.

5. Locals (Guides)

As a Local, you agree to:

• Provide truthful information about yourself, your location, expertise, languages, and hourly rate.
• Offer experiences that are legal, safe, and consistent with how you described them.
• Respond to booking requests in a timely manner and honor confirmed bookings.
• Maintain any licenses or permits required by local law to provide the services you offer.
• Not solicit or accept payment outside the Platform for experiences arranged through SousDey.

6. Bookings and payments

When a Traveler books a Local, a booking is created at the agreed hourly rate and duration. Payment is collected through the Platform. SousDey facilitates the transaction and, where applicable, remits earnings to the Local through the payout method the Local has selected. Prices are listed in USD unless otherwise stated. Taxes, if any, are the responsibility of the Local where required by law.

7. Cancellations and refunds

Our cancellation policy is designed to protect both parties:

• Travelers may cancel free of charge up to 48 hours before the scheduled start time for a full refund.
• Cancellations made within 48 hours of the start time are eligible for a 50% refund.
• No-shows or same-day cancellations are non-refundable.
• A Local may cancel a booking at any time; in that case the Traveler receives a full refund.
• Refunds are processed back to the original payment method and may take several business days to appear.

8. Reviews

Travelers may leave reviews after an experience. Reviews should be honest and based on your actual experience. You may not post fraudulent, abusive, or retaliatory reviews. SousDey reserves the right to remove reviews that violate these Terms or our community guidelines.

9. Conduct and prohibited activity

You agree not to use SousDey to:

• Violate any applicable law or regulation.
• Harass, threaten, or harm another user.
• Discriminate against anyone based on race, nationality, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Offer or request illegal services, including anything that endangers the safety of any person.
• Interfere with the proper functioning of the Platform or attempt to access it in an unauthorized way.

10. Content and intellectual property

You retain ownership of the photos, text, and other content you submit to SousDey. By submitting it, you grant SousDey a worldwide, royalty-free license to display and use that content for the purpose of operating and promoting the Platform. You confirm that you have the rights to any content you upload and that it does not infringe the rights of any third party.

11. Limitation of liability

SousDey provides the Platform on an "as is" basis. To the fullest extent permitted by law, SousDey is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform, or from any interaction between a Traveler and a Local. SousDey does not guarantee the performance, safety, or quality of any experience arranged through the Platform.

12. Modifications to these terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of SousDey after changes take effect means you accept the updated Terms.
